- The legally binding conditions between investors and  borrowers shall  be contained in the specific legal   documentation pertaining to such investment and in the terms of use of PrivateLending.

- PrivateLending is not regulated nor supervised by any governmental authority and does not perform regulated activities.

- Ratings or credit  assessments provided by PrivateLending are of indicative nature only, and PrivateLending shall incur no liability in connection therewith. Investments are made  at the sole risk of the investor and such  investor should properly make the relevant risk assessments before deciding to make and investment.

PrivateLending SA (“PrivateLending”) is active in finance, corporate finance and all matters involving the financing of corporations. To do so, PrivateLending gathers and processes your personal information in accordance with this privacy notice and in compliance with the relevant data protection Regulation and laws. 

1.2. PrivateLending’s privacy policy is governed by the data privacy laws of the European Union i.e. the General Data Protection Regulation (GDPR) effective since 25th of May 2018.

2.1. General – PrivateLending processes your personal information to meet our legal, statutory and contractual obligations and to provide you with our products and services. We will never collect any unnecessary personal data from you and do not process your information in anyway, other than as specified in this notice.

- Online forms
- Contractual processes between your company and PrivateLending
- E-mails or messages you sent to one of our staff members
- Visit to our headquarters or stands during a exhibition
- Business cards you gave to one of our staff members
- Calls and conversation with one of our staff members

3.1. The purposes and reasons for processing your personal data are detailed below:
- We collect and store your personal data with your consent to provide you with our marketing information, understand the effectiveness of our marketing, send certain marketing communications, deliver relevant advertising to you and notify you about changes to our service and ensure that the content from our website is presented in the most effective manner for you and for your computer.
- We collect and store your personal data in the performance of a contract between you and PrivateLending.

- We collect and store your personal data in our legitimate interests of providing the best service and growing and improving our business and services, keeping our website and systems safe and secure, understanding our customer base, identifying trends, defending against or exercising legal claims and investigating complaints.

4.1. PrivateLending takes your privacy seriously. We work hard to protect you and your information from unauthorised access, alteration, disclosure or destruction and have several layers of security measures in place, including SSL, TLS, encryptions, pseudonymisation and restricted access 

5. Sharing and disclosing your personal information 

5.1. We will never sell or extract any financial value from your personal information by passing them to interested third-parties willing to commerce these personal data. 

5.2. Nevertheless, we may pass on your personal information to third-parties acting as data processors on behalf of PrivateLending and which renders specific services to PrivateLending.  Please note that we will ensure that all data processors acting on our behalf only process your data in accordance with instructions from us and comply fully with this data protection laws and ensure confidentiality and have security measures in place.  The following third-parties currently intervene as data processors to PrivateLending. 


6. How long we keep your data 

6.1. PrivateLending only ever retains personal information for as long as is necessary and we have strict review and retention policies in place to meet these obligations. 

6.2. Where we use your details for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent (if based on your consent), or for two (2) years following your last activity with us, whichever is the latest. Other terms are specified in each specific sections related to a specific retention of personal data.

7.1. You have the right to (a) access any personal information that PrivateLending processes about you and (b) request information about:
- What personal data we hold about you
- The purposes of the processing
- The categories of personal data concerned
- The recipients to whom the personal data has/will be disclosed

7.2. If you believe that we hold any incomplete or inaccurate data about you, you have the right to ask us to correct and/or complete the information and we will strive to do so as quickly as possible; unless there is a valid reason for not doing so, at which point you will be notified.
